What's the matter with kids today? Well, in the case of some young "women" in Minnesota...

Respect for one's elders seems to have been a lesson someone overlooked! This post in "The Smoking Gun"--"Teens charged in nursing home abuse"--should want to make anyone think twice about leaving a loved one in a nursing home when the "candy stripers" are caring for them. (Fair Use claimed.):

DECEMBER 2--A group of teenagers working at a Minnesota nursing home abused and sexually humiliated elderly residents suffering from Alzheimer's disease and dementia, prosecutors allege. The six young female caregivers were named yesterday in criminal complaints charging them with a variety of cruel behavior at the Good Samaritan Society nursing home in Albert Lea, a city in southern Minnesota. Only two of those charged--Brianna Broitzman, 19, and Ashton Larson, 18--are named in the complaints since they were not minors when the alleged abuse occurred. According to District Court complaints filed against Broitzman (pictured above left) and Larson (above right), nursing home residents were spat upon, spanked, improperly touched, and tormented by the teenagers earlier this year. ... The minor caregivers are identified in the complaints by their initials and dates of birth. Broitzman, charged with 11 criminal counts, and Larson, charged with 10 counts, face a year in jail or up to a year in jail on each of the raps.


HUH?? Shocked These "animals" (no offense to animals) tormented and sexually abused sick, vunerable elderly people and the worst penalty that ANY of them may face is...a year in jail for each count they are convicted on??

Apparently, yes, that's all the potential time in the "Gray Bar Motel" any of them may well face under Minnesota law! The Minnesota "Vunerable Adult Act", Minn. Stat. ยง626.557, prohibits abuse of the vunerable elderly/disabled.

What constitutes abuse? Minn. Statutes 609.2325 states that for abuse to rise to criminal level, the abuse must meet these requirements:

609.2325 CRIMINAL ABUSE.
Subdivision 1.Crimes.

(a) A caregiver who, with intent to produce physical or mental pain or injury to a vulnerable adult, subjects a vulnerable adult to any aversive or deprivation procedure, unreasonable confinement, or involuntary seclusion, is guilty of criminal abuse and may be sentenced as provided in subdivision 3.

This paragraph does not apply to therapeutic conduct.

(b) A caregiver, facility staff person, or person providing services in a facility who engages in sexual contact or penetration, as defined in section 609.341, under circumstances other than those described in sections 609.342 to 609.345, with a resident, patient, or client of the facility is guilty of criminal abuse and may be sentenced as provided in subdivision 3.


What are the penalties for those who are guilty of criminal abuse? Depends; Subdivision 3 of this Section states:


Subd. 3.Penalties.

(a) A person who violates subdivision 1, paragraph (a), may be sentenced as follows:

(1) if the act results in the death of a vulnerable adult, imprisonment for not more than 15 years or payment of a fine of not more than $30,000, or both;

(2) if the act results in great bodily harm, imprisonment for not more than ten years or payment of a fine of not more than $20,000, or both;

(3) if the act results in substantial bodily harm or the risk of death, imprisonment for not more than five years or payment of a fine of not more than $10,000, or both; or

(4) in other cases, imprisonment for not more than one year or payment of a fine of not more than $3,000, or both.

(b) A person who violates subdivision 1, paragraph (b), may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both.


Look at the bolded parts. Then, look at some of the actions that the two identified defendants are accused of doing as listed in the criminal complaint (posted at "The Smoking Gun"):

Brianna Broitsman admitted that she and Ashton Larson poked SW in breasts.

RNM stated that Brianna Broitsman said that she would poke residents in the breasts. RNM stated that this was done for fun and not to cause pain.

RNM stated that Brianna Broitsman and Ashton Larson told her about spanking C.K. JMS was told that he would laugh and the girls would keep doing it. They would play with his cane, ride it like a horse, and spank C.K. on the buttocks with it and Ashton Larson admitted that she patted C.K.'s buttocks.

AMR stated that Ashton Larson would rub vigorously on residents' peri-anal areas (genital areas) to sexually arouse them. She recall that Ashton Larson and Brianna Broitsman talked about doing these types of things to residents on four to five occasions with the "girls".

AMH stated that she was told by Brianna Broitsman that Ashton Larson inserted her finger into a resident's rectum. Ashton Larson was present during this conversation and did not deny it.


MRV stated that she was told that resident KH was touched or rubbed by Brianna Broitsman and as a result KR became "hard." MAW stated they were just trying to gut a rise out of him, as in sexual teasing.


SLS stated that Brianna Broitsman would poke. residents in breasts and genitals and laugh. SLS stated that Brianna Broitsman would poke J.J. in breast, tap her on the forehead, and put her fingers in her mouth until she would scream. She stated that she witnessed Brianna Broitsman hit resident RH in the genitals so he would scream in March or April of 2008. SLS stated that Brianna Broitsman would put her gloved hand in the resident's nose and mouth to make then scream because she thought it was funny.


Would you consider such sadistic actions--and this is just a sample--to be low-level misdemeanors?? Would YOU think that these actions were "in fun" and the patients would actually WANT some tart to "play with" them in such a manner??

I think I owe you for this one...... before reading this I was ready to rip BSM's non-existant testicles off and choke him with air (because I know he has no balls so there would have been nothing to rip off) Damn can u tell I'm pissed........ ANYWAY...... this article brought things back to the important things in life...... RESPECT and our Elderly......
